Any Member of Parliament (MP) ordered to leave the Dewan Rakyat must not only exit the chamber but is also barred from sitting in the public gallery, stated Tan Sri Johari Abdul.

The Dewan Rakyat Speaker issued this ruling on Monday (Oct 18) after Datuk Seri Takiyuddin Hassan (Kota Baru-PN) raised concerns, arguing that suspended Machang MP Wan Ahmad Fayhsal Wan Ahmad Kamal should still be permitted access to the public gallery.

00:00Mr. Tan Sri, on the 21st of October, a few days ago,
00:09I submitted the same resolution to the Speaker, Cameron Highland,
00:20but he asked me to submit it again to you, Mr. Tan Sri,
00:26because it is directly related to you.
00:29This matter is related to a letter that was sent by Mr. Tan Sri himself to Mr. Macang
00:38on 15 October 2024,
00:43related to the suspension of the meeting of the People's Congress on him,
00:51which was held on 18 July 2024.
00:56He was suspended for six months
00:58from attending the meeting of the People's Congress.
01:03I refer to paragraph 44.5, which states that
01:07if an ally has been suspended from attending the meeting of the People's Congress,
01:13he is directed to leave the meeting
01:17and cannot take part in the meeting until the suspension ends.
01:25As usual, Macang was directed to leave the meeting.
01:37However, when the third meeting of the People's Congress was held on 14 October,
01:47he was present on the 14th and 15th.
01:52However, he sat in the public gallery of the People's Congress.
01:58We, on behalf of Macang, feel that the direction of Mr. Tan Sri through this letter is in our opinion,
02:09not in accordance and not in accordance with the rules.
02:14Because the public gallery, as well as the public gallery in front of this council,
02:20is a public place, a place for people who are not members of this council,
02:25whether they are members of this council for a long time or depending on their services.
02:31I have given the example of a soccer player who has been thrown out of the field,
02:37sent off, red card, thrown out of the field.
02:41He cannot sit on the field, but he can sit in the public gallery.
02:48Although Mr. Mohamad mentioned in this letter,
02:51he can be in the Parliament building following the broadcast.
02:58He is different from sitting in the stadium and following the broadcast.
03:05Whatever our opinion,
03:08when Mr. Mohamad directed Macang to go out,
03:11he never said that Mr. Mohamad cannot be in this council,
03:17including in the public gallery or anywhere in this council.
03:21For me, that is a benefit of the doubt.
03:26Benefit of the doubt should be given to the accused person.
03:30The accused person in this matter is Macang.
03:33Mr. Mohamad did not say anything at that time.
03:35He just went out of this council.
03:37And I said, sitting in the public gallery,
03:39what can he take part in?
03:41He can just watch.
03:43He cannot speak.
03:44He cannot even speak loudly and so on.
03:46So, for me, as a defender,
03:49we see Mr. Mohamad,
03:52we doubt that Mr. Mohamad has re-evaluated,
03:55reviewed this direction.
03:57At least he can sit in the public gallery.
04:00Six months, Mr. Mohamad.
04:02That is a big punishment.
04:05It is not equal to his sentence.
04:08So, I ask for a ruling from Mr. Mohamad
04:11so that he can review this direction.
04:19Mr. President.
04:20What do you want to say, Mr. President?
04:22It is the same thing.
04:23It is all about sharing.
04:24If it is the same thing, there is nothing to say.
04:26No, it is sharing.
04:27This is sharing.
04:28I want to make a decision.
04:29No, it is sharing.
04:31Be patient.
04:33It is the same thing.
04:35In fact, in 2017,
04:39when I was in the government,
04:41in front of Tan Sri now,
04:45Tan Sri Lim Kit Siang,
04:49and the direction from the speaker at that time,
04:54and Tan Sri was also in the court at that time,
04:58and his decision,
05:00he can sit.
05:02And I asked him to take action under Article 44.7
05:06so that he can issue it.
05:08But he did not take it.
05:09According to the convention,
05:11the same thing should be done.
05:13Tan Sri should investigate and allow
05:16as if he was in the court
05:18without taking part.
05:20That's all, Mr. President.
05:22Okay, this is my decision.
05:24While I am the one who was appointed today,
05:27starting from 15 October 2024,
05:31whoever is appointed to leave,
05:35or is ordered to follow this convention,
05:39the meaning of leaving is to leave this chamber.
05:44He can follow from outside,
05:47but he cannot enter the chamber.
05:49Because this will cause a lot of problems.
05:52So I made a decision,
05:54he cannot enter the chamber,
05:57including this area.
05:59That's my decision.
