04:58and now we come to my decision.
05:00This is an extremely difficult case.
05:03We have here two loving, caring parents,
05:06both of them absolutely dedicated to the welfare of their children.
05:11Now, in such a finely balanced case as this,
05:14if you're going to have a change of carer,
05:16then the advantages of any change
05:19must significantly outweigh the detrimental effects.
05:23The father has shown himself dedicated to the children
05:25over a number of years, and I was impressed by his evidence.
05:28The court had already given him residence of the children,
05:31and that would no doubt still be the case today,
05:33had it not been for the wrongful abduction of the children by the mother.
05:37However, the father, too, is to be reprimanded
05:39for his reabduction of the children.
05:42This behaviour is not acceptable.
05:45Both parents now rightly are allowing the court
05:48to decide the future of their children.
05:51Now, the father's excellent care continues to this day.
05:54However, I was equally impressed by the mother.
05:57She's shown dedication, commitment to her children.
06:01She's created for herself a stable lifestyle and a lasting relationship,
06:05and she seems to have learned from her mistakes.
06:08However, there are areas of concern.
06:11The mother was not frank with the court about her pregnancy.
06:14Whilst I deplore the fact this was hidden from the court,
06:17in itself it does not reflect on her ability to care for her children.
06:22The mother has said that she will provide generous contact
06:25and foster good relations between the children and the father,
06:28and the father says the same.
06:30And indeed, he had given contact until immediately prior to this hearing,
06:34and he cites a rise in tension for his reason for the refusal to give access,
06:40and I find that understandable.
06:42Now, thus far, both parents are on equal terms,
06:46and there is nothing here to justify a move
06:49from the father's care to that of the mother's.
06:52However, the children need and love both parents equally,
06:56and it is vital that the parent with whom the children are living
07:00allows them to love and have a high regard for the absent parent.
07:04Now, the father looks to his extended family for support,
07:08and I see here an obvious and deep-seated antagonism
07:12on the part of the father's family towards the mother.
07:15Indeed, I was struck by the evidence of the paternal grandmother,
07:18Mrs Catherine Mitchell.
07:20She may try to disguise these feelings in front of the children,
07:23but I do not wish the children to risk being exposed
07:26to such a severely prejudicial view of their mother,
07:29and it is for this reason, by the narrowest of margins,
07:33that I make a residence order in favour of the mother
07:36with generous contact for the father.
07:39We'll take a few moments' break,
07:41and when we come back, we'll look at the details of the order.
