Expunging your record is a key step, but probation must be terminated first. For those seeking employment or looking to transfer jobs, early termination can remove many of these barriers.

Next, we outline the steps you’ll need to take to petition for early termination. The process isn’t automatic, so you’ll need to put together a strong case. This includes gathering reference letters from not only friends and family but also professional colleagues who can vouch for your character and acknowledge that you’ve taken responsibility for past mistakes.

We also stress the importance of fulfilling all your probation requirements—such as paying fines and completing any required community service—before filing for early termination. Many people fail to meet these basic requirements and end up wasting time and money filing too early.

00:06And today we're exploring the critical topic for many in orange County and
00:10beyond early termination of probation.
00:13This can be a game changer for a lot of people with a criminal record,
00:16opening doors that were once closed.
00:19Let's dive into our comprehensive seven step guide to help you understand
00:23successfully petition for early termination.
00:25Why early termination can change your life.
00:29Many times when we are on probation,
00:32it's a hindrance because we have a conviction on our record.
00:36When we have a conviction on a record and fill out job applications,
00:40it creates problems,
00:42especially if you're in an existing job and you want to transfer to another
00:46location. On top of that,
00:49other things could happen if you wanted to get an entry level job.
00:53These convictions can slow you down in your job application.
00:57The first step towards early termination.
00:59When you are trying to get the court to exercise the discretion
01:04to terminate your probation, I want to say nothing else than, Hey,
01:09just because you ask for it, the court is going to grant it for you, right?
01:13That's not the case. You have to put together a package.
01:17And part of this package is getting a lot of references and people who will
01:22vouch for you, not just your friends and family,
01:25but also your professional colleagues and coworkers as well.
01:29And these letters have to be impactful as well.
01:32They can't just say, Joe Schmoe is a good person. I like him.
01:36It has to spell out who you are and acknowledge the
01:41fact that you made a mistake and that they're aware of it.
01:44But regardless of that, they still think that you're deserving of relief.
01:49Meeting your probation requirements.
01:51Another thing that you have to have down is completing all the probation
01:56conditions,
01:57like paying your fines and attending all required programs before filing for
02:01termination.
02:02You do not know how many times that people have gone up to me and say, Hey,
02:06I want to terminate my probation. And also I want to expunge my record,
02:10but they have not paid their fines. If this is the case,
02:15save your money, go pay your fines, complete your community service.
02:20And then you can entertain terminating probation because if you went forward
02:25with it anyways, you will be just wasting your money.
02:29Step four down there in the description,
02:32I'll give you a link that lets you get your rap sheet.
02:34The rap sheet details all your incidences with law enforcement,
02:38along with case numbers and conviction to hire an attorney or not.
02:44There are pros and cons to hiring an attorney to do this for you versus
02:48self-representation for early termination of probation.
02:52If you hire an attorney, they know what to do.
02:55They're familiar with the local court process. And on top of that,
02:59you have a higher degree of success.
03:01The cons of it is that you will have to pay for hiring an attorney.
03:07The attorneys do not work for free and you will be charged.
03:12These are things to think about. Not everybody has the same financial situation.
03:16So only, you know, best in this case, navigating the paperwork,
03:21the paperwork is below. There'll be instructions on how to fill it out.
03:25It's pretty self explanatory. After you fill them out,
03:28then you have to secure a date for your hearing.
03:31This can be done of two, one of two ways. And it depends on your courthouse.
03:36You can write it in yourself and then go follow it.
03:38Or the second one is you go to the clerk and then you ask the clerk what dates
03:42they're setting these at. If you are unfamiliar,
03:45I would suggest that you go to the clerk and ask because then the court clerk
03:50will also know which room it's at as well. What to expect at the hearing.
03:55When you have your court hearing for a termination of probation,
03:58it's going to be about equity.
03:59The district attorney will argue that a deal is a deal.
04:03You agreed to it and you're going to say equity. You've been a good person.
04:08And also you have all these people vouching for you.
04:11This is the pivotal moment and this is what happens during the hearing.
04:16You got to prepare and explain and be ready to tell the judge.
04:20Why is it that you should get some kind of leeway?
04:25This could be that you've done more than your fair share of probation or you
04:29went more beyond or you went above and beyond.
04:33Early termination of probation can be a crucial step towards reclaiming control
04:36of your life. Remember,
04:37each step in this process brings you closer to a future where your past doesn't
