00:00Before the commencement of trial and court proceedings in a lawsuit filed by Femi Falano,
00:05a senior advocate of Nigeria, S.A.N. and a popular human rights lawyer against Martin Scorsese
00:12a.k.a. Veridagman who prides himself as online police,
00:15a federal high court sitting in Lagos State has issued a pre-trial order
00:19asking Veridagman to remove the videos and comments he made on social media platforms
00:24in which Veridagman expressed his own opinion about Femi Falano and his son.
00:28Folari Falano a.k.a. falls over their alleged conspiracy with a cross-dresser, Idris Okunye a.k.a. Bobriski
00:35to undermine Nigeria's legal system.
00:37The court asking Veridagman to remove the entire video which parts contain alleged self-confessional
00:43voice message of Bobriski which the audio voice has become an issue of public interest and importance.
00:49The action of the court may be seen as aiding and abetting parties whose names were mentioned
00:54in the audio voice message to cover up public truth or delay public right to know.
00:59The ruling of the court on the ground of common sense may be a clear case of judicial oppression
01:04and intimidation of a person of public informant or a source of public information
01:09because Femi Falano in the pre-action lawsuit apparently is not challenging the authenticity
01:14of the audio message if it was original or fabricated but he appears to have only seek legal interpretations
01:21to the fundamental rights of freedom of expression of Veridagman to express his own personal opinion
01:27as a result of the contents of the audio message.
01:30Bobriski who is the suspected person to be the original owner of the voice in the audio message
01:36have refused to honor Nigeria lawmakers.
01:38The National Assembly invitation to investigate the authenticity of the audio recording
01:43rather he chose to be represented by proxy through his lawyer.
01:48An action that has infuriated the lawmakers.
01:51We are not aware of any report that Bobriski has filed court action against Veridagman
01:57challenging the authenticity of the audio message.
02:00Veridagman had on September 24, 2024 released an audio recording with a voice
02:06that apparently looked like that of Bobriski, saying in the audio that he allegedly paid money
02:12to Femi Falano to process state pardon and gained other special treatments
02:16at the Nigeria Correctional Service when he was jailed six months for Naira mutilation and abuse.
02:22Veridagman in his own opinion when he met the audio public said he would feel disappointed
02:28if truly Femi Falano and files were actually involved in the allegations raised
02:33in the likely self-confessional audio voice of Bobriski.
02:37The Federal High Court in Lagos on Monday issued an interim order restraining Martins Vincent O'Shea
02:44known as Veridagman to remove the videos and prohibited him from further publishing the content
02:50about the human rights lawyer, Femi Falano, son.
02:54The court directed Veridagman, his agents, and any associates to remove the defamatory videos
03:00and comments posted on September 24, 2024 across all his social media platforms.
03:07Justice Elmo Dawudu granted the order on Monday, pending O'Shea's compliance with the pre-action protocol of the court.
03:15The ruling comes in response to a lawsuit numbered ID-586-GCM-2024 filed by Falano against Veridagman.
03:26Justice Dawudu granted the applicant's prayers, seeking the following reliefs.
03:31An order of interim, pre-emptive remedy by this Honorable Court restraining the defendant, his agents,
03:38privies, and or anyone from further circulating or publishing any defamatory videos,
03:44comments about the applicant, and to remove the defamatory videos,
03:48comments published on the 24th of September 2024 from all his online social media handles pages,
03:55pending compliance with the pre-action protocol of this Honorable Court.
04:00An order granting leave to the applicant to serve the pre-action.
04:04Bandles, originating processes and all other court processes between parties
04:09hearing on the defendant by substituted means through his lawyer,
04:13Deji Adeonju Esquire of Deji Adeonju and Partners at Terrace Block D4,
04:18White Diamond Estate, Makuru Street of Embu Street of Aminu, Wuseitu, Abuja.
04:26Such further orders as this Honorable Court may deem fit to make
04:30in the circumstances of this ex-party application.
04:33Meanwhile, the notice stated that the grounds upon which this application is brought
04:39are that the claimant, applicant is a legal practitioner, a senior advocate of Nigeria,
04:45a former national president of the Committee for the Defense of Human Rights,
04:49and a former president of the West African Bar Association.
04:53The defendant is a social media entertainer known on Xapp, formerly Twitter,
04:58as atatverdagman and on Instagram app as atverdagblackman.
05:02The court ruling reads,
05:04The defendant published a video on September 25th, 2024,
05:09on his Instagram handle atverdagblackman where he made unsolicited comments.
05:14These,
05:15In everything and everyone that is mentioned here,
05:19I will be disappointed if truly false and his father are involved in this whole Bobrisky issue.
05:25Once the bad guy contacted Bobrisky and contacted his father,
05:29Femi Falano spoke to Bobrisky in order to divert justice,
05:33a whole Femi Falano will engage himself in something like this.
05:37Alright, based on this false voice note,
05:41Bobrisky is saying that Femi Falano collected 10 million nairas in order to wipe his name off the record.
05:47These are people I respected.
05:50So, you can also be involved in things like these.
05:54I have lost 100% respect for these.
05:57For now, I take what Bobrisky said as the truth.
06:01In his ruling, Justice Dawoodu Judge said,
06:05The applicant has a legal right to be protected from being defamed by the actions of the defendant.
06:11Whether this action will succeed can only be determined during the hearing of the matter.
06:17There is no doubt that the applicant has a legal right not to be defamed
06:21and has proved the possible existence of a breach of same through the depositions in his affidavit.
06:38From the affidavit evidence and the documents in support thereof,
06:42it is clear that there are substantial issues to be tried in this matter.
06:46The balance of convenience seems to be in favor of the applicant
06:50and damages might not be adequate compensation,
06:53especially more so that the defendant might not be in good financial standing to compensate the applicant if the court finds in his favor.
07:01From the foregoing, this court finds that the applicant has satisfied the conditions stated in Adereke v. Lawal, Supra.

07:30In addition to the order for pre-emptive remedy,
07:33the applicant is also seeking leave of cause to serve the defendant with the pre-action bond dues,
07:39originating processes and all other court processes between parties by substituted means through his lawyer Deji Adeyonju Esquire of Deji Adeyonju and Partners at Terrace Block D4,
07:49White Diamond Estate, Makuru Street of Embu Street of Aminu, Wuseitu, Abuja.
07:56It is noted that the reason why the defendant, very dark man, should be served through his lawyer is because he is not known to have any verifiable physical address
08:06except that he is very active on social media platforms.
08:10The judge ruled, the defendant, his agents, and privies are hereby restrained from further releasing, publishing, or circulating any defamatory videos,
08:21comments about the applicant and to bring down the defamatory video,
08:25comments about the applicant published on the 24th of September 2024 on all his online social media handles, pages pending,
08:34compliance with the pre-action protocol of this Honorable Court.
08:38Leave is hereby granted to the applicant to serve the pre-action bond dues,
08:43originating processes and all other court processes between parties hearing on the defendant by substituted means through his lawyer Deji Adeyonju Esquire of Deji Adeyonju and Partners at Terrace Block D4,
08:57White Diamond Estate, Makoro Street of Embu Street of Aminu, Wuseitu, Abuja.
09:04The applicant must file and serve the pre-action bond dues, originating processes, and other accompanying processes on the defendant within 14 days from today.
09:15The order in one above shall lapse after 21 days from today, the judge added.
09:21In the pre-action notice filed on September 30, 2024, Femi Faleno, SAM, through his counsel Olorunfebi Akinyemi, Esquire, wrote to Veridakman,
09:34requesting that he publish an apology to the claimant on all his social media handles, pages for the defamatory statements made in the video in question.
09:44The notice also demands a full retraction of the statements and the removal of all offensive videos from online platforms.
09:52According to Akinyemi, Mr. Faleno has been inundated with calls, messages and physical visits from countless individuals and corporate bodies all over the world who read,
10:03viewed or listened to your mendacious, reckless and offensive publication and expressed profound dismay and displeasure with the alleged misconduct in the publication and
10:13the have all threatened to disassociate from him unless he clears his name through a court of law.
10:19The notice said, Your action was motivated by economic gains that you would derive from the reckless, thoughtless and false publication of the offensive and
10:28libelous video and statement while pretending to run a commentary on a purported unverified audio recording of a private one-sided phone narrative allegedly by a Bobrisky.
10:39We have seen and read your solicitors, Deji Adeyanju and partners.
10:44Response to a letter also dated September 25th, 2024 posted online wherein you confirmed the publication of the defamatory video containing the offensive words but
10:54futilely attempted to deny defending our home was described as a renowned senior advocate of Nigeria and globally recognized human rights activist.
11:04You have failed to tender an unresolved apology and a full retraction of the defamatory video till date.
11:11Sen continues to be viewed by your millions of online followers and is trending all over the world till this moment.
11:18You know or ought reasonably to know that the content of the sent publication by you is false, reckless and libelous.
11:26We position that our client consider litigation only as a last resort and is not averse to an amicable resolution via any alternative dispute resolution method you deem suitable in the circumstance.
11:39We request that you publish an apology to the claimant on all your social media handles.
11:44Pages for the defamatory words contained in the video complained of and a full retraction of Sen, including bringing all the offensive videos down online.
11:54You restrain your online followers, agents or servants or otherwise from further publishing or causing to be published the said similar words, videos defamatory to the claimant.
12:06Payment of the sum of 500 million nairas, 500 million naira only, as damages for the defamation of character contained in the online publication of September 24th, 2024.
