00:00You are on bond in this court for
00:17a terroristic threat.
00:20What is the only thing that I asked
00:23you, we asked you not to do?
00:26What did you do?
00:30Guess what happens now?
00:33Yes, no guesses.
00:38You're clairvoyant.
00:43He goes with you.
00:44He's on bond for
00:47the terroristic threat and
00:52picked up a felony theft.
00:54No, sir, you will stay with me now.
00:58Mr. Spiller, you're back yet again.
01:03Both of you gentlemen are charged
01:07with possession of marijuana.
01:11You are facing up to six months in jail
01:14and are a $2,000 fine.
01:16We are going to do probable cause.
01:18You have the right to remain silent.
01:20Anything you say cannot will be used
01:22against you.
01:22You have the right to remain silent.
01:24You have the right to remain silent.
01:26Anything I say against you.
01:28You have the right to have an attorney
01:30present if you cannot afford one,
01:32one will be appointed to you, okay?
01:33Officers were investigating controlled
01:35by for a possible stolen skid steer
01:37from a known felony theft.
01:38Suspects who had an active felony
01:40theft warrant involving sale.
01:41I was on skid steer officers.
01:43Okay, stolen one skid steer skid steer.
01:48Your honor appears to be like a
01:51tractor of some sort,
01:54of some sort. Kind of like a small bulldozer. That's what it appears based on the images.
01:59What's the value of that? It's got to be felonious for sure.
02:04I'm not sure about the value in this present case, but they range from five to thousand.
02:11So officers observed the suspect vehicle follow the officer's unmarked vehicle for several miles,
02:16making the same turns and traveling the same routes. Officers conducted a stop for the
02:20expired registration and no return of valid proof of financial liability.
02:24Occupants were Defendant Spiller, Defendant McGuire, and known felony theft suspect Defendant
02:28O'Neill. Officers observed in plain view several clear baggies containing a green leaky substance.
02:33Officers knew from training and experience the substance was marijuana and it was within the
02:37center console in the immediate reach of both Defendant Spiller and Defendant McGuire. The
02:41weight was 1.01 ounces. Defendants exited the vehicle and the officers located a pistol in
02:48the front center of the front passenger door area where Defendant McGuire was sitting.
02:51A clear baggie with a green leaky substance that officers knew to be marijuana and on Defendant
02:57McGuire's person a key to the skid steer in the backseat area where Defendant O'Neill was sitting.
03:03Defendant McGuire claimed ownership of the pistol.
03:09So no gun case I guess.
03:13Did they guys confiscate the weapon?
03:15And so where was where was the marijuana again? Marijuana I think was in the center console.
03:22So how do we get Spiller into this thing?
03:29So the officer says officer observed in plain view several clear baggies and it was within the reach
03:35of both Defendant Spiller and Defendant McGuire.
03:38Did anyone claim ownership of the weed? It doesn't say that they did. I know that, like I said,
03:43Defendant McGuire claimed ownership of the pistol but I don't believe there was any ownership claim for the weed.
03:51Who's driving the car?
03:57And I guess in that as well, who owned the car?
04:01Okay.
04:31Okay.
05:01I'm looking for the office support.
05:07No problem.
05:31The driver of the vehicle was Defendant Spiller.
05:44And I believe the owner of the vehicle was Spiller as well.
05:56So the weed was just you said in the center console, right?
06:07The marijuana, the office report states that the marijuana was in plain view of the officer and that it was in reach of both Defendants.
06:15I mean, I'm down with it on Spiller, but I'm not going to impute it to McGuire, you know?
06:45I mean, if you can show me somehow that he has care custody control somehow, then I'll find PC on McGuire.
06:55But otherwise, I'm going to find a probable cause. But I am going to find a probable cause on Spiller.
07:00I'm just looking for the offense report from Pasadena.
07:04And I mean, we can because we have a lot of people waiting. Let's do this.
07:08I'll give you a little time. Mr. McGuire, take a seat from the jury box for now.
07:12Mr. Spiller, I'm going to find that there's probable cause to go forward to the case.
07:16Do you have a Texas driver license? Run his license, please, as well.
07:20I'm ordering you now as the condition of your bond not to consume alcohol, illegal drugs or some prescribed controlled medication.
07:27I'm going to randomly test you. Mr. Spiller, I'm sending you for a drug test right now as well.
07:31And I want to know what, if anything, is in your system.
07:34If it's just weed, I'm going to test you again in 35 to 40 days.
07:38And if I find that you continue to smoke weed, I'm going to put you in jail.
07:41Do you understand? Yes, sir.
07:43This is now your fifth case within the last...
07:56Your fourth case within the last year and a half.
07:59Things are not going well. What do you do with your life?
08:02Work. Doing what?
08:04Construction.
08:06Is it a full time job? Yes, sir.
08:08Did you graduate from high school?
08:10Yes, sir.
08:11I'm sending you for a drug test. You must come right back.
08:14Do you understand? Yes, sir.
08:16When you come back, we'll talk about your lawyer's situation.
08:18Don't jet. Otherwise, I'll revoke your bond.
08:21And I'm telling you now, I'm going to make it sky high.
08:24Do you understand? Yes, sir.
08:26Okay. I will have you sign a resale with Victoria and then we'll send you down here momentarily.
08:31That way.
08:32Okay.
08:38Mr. Roy, how's jail?
08:42Really?
08:45You really don't like it or you just kind of don't like it?
08:48It's over with for me. I've been through.
08:52I don't know.
08:54You know,
08:57why do we have jails?
08:59Tell me.
09:00Okay. Why else?
09:03Bad actors and keep people safe.
09:06Is that you?
09:08Which one?
09:10All of the above.
09:11No, sir.
09:12Really?
09:14Tell me why not.
09:16Okay.
09:17For the past three years, I've been in school.
09:19I graduated from University of Kansas Business Management.
09:22Since I've been on probation,
09:25I've worked 12 hours a day and I've just been clean.
09:29It's just unfortunate this situation happened.
09:34Since 1994, Mr. Roy,
09:371, 2, 3, 4, 5, 6, 7, 8,
09:489, 10, 11, 12, 13, 14, 15, 16, 17,
09:5518, 19, 20, 21
10:01crimes.
10:03And in 2021, you pick up an injury to a child under 15
10:08with serious bodily injury.
10:10You get on felony probation in 21.
10:13Now you've picked up a Class A criminal mischief,
10:17which is all about self-control.
10:20I don't even know what happened in this case,
10:22so we're going to find out real quick.
10:25But let me ask you again.
10:28Why do we have jails?
10:34Is that you?
10:36No, sir.
10:37Should we go through the criminal history again?
10:39Okay.
10:40When you say 94, I'm 48 years old now.
10:43When you say 94, I'm 48 years old now.
10:49If you go back to 2006,
10:52from 2006 all the way to 2021,
10:54I haven't had no major cases.
10:56Y'all haven't seen me in y'all jails from 2006.
10:59Were you in prison?
11:01No, not 2006.
11:02I got out in 2006.
11:04And from 2006...
11:05That's why you didn't get in trouble.
11:07No, 2006 to 2021,
11:09I haven't gave y'all no problems.
11:11I was on the road to change.
11:12Unfortunately, in 2021,
11:13this incident happened.
11:14They gave me felony probation
11:15because they couldn't really prove it
11:17and I could get this wiped off my case
11:19with judicial probation.
11:21Now, three years later after that,
11:23I get this,
11:24which we don't have the real information
11:27on why this case came about.
11:29Let's do probable cause.
11:30But I did...
11:35One of the main other reasons
11:37that we have jails
11:38are for you to learn
11:41to learn
11:43for you to understand that
11:48everybody in custody now
11:52no self-control.
11:55They wig out,
11:56do whatever they want to do,
11:58injure whoever they want to injure,
12:00kill whoever they want to kill
12:02without thinking of consequence.
12:09What happened here?
12:10922 officer was dispatched
12:12to 8319 Cardamom Lane
12:14in Harris County, Texas.
12:16The complaining witness,
12:17who is the defendant's sister,
12:18told the officers
12:19that the defendant accused her
12:20of stealing his wallet.
12:22The defendant got aggressive
12:23and grabbed a gallon bottle of soap
12:24and attempted to hit her son with it.
12:26The complaining witness
12:27began to get in her vehicle
12:28with her son to leave
12:29while the defendant
12:30was still attempting to hit the child.
12:32When the complaining witness
12:33returned from the house,
12:34there was a hole in the wall.
12:35A PlayStation 5 was broken on the floor
12:36and her son's school-issued tablet
12:38was also broken.
12:39Later, the defendant received
12:40a call from Walgreens
12:41that he had left his wallet
12:42at the store earlier that day.
12:43Total damage is approximately
12:45$2,750.
12:52So, you think that
12:54allegedly here,
12:58because mom takes a wallet,
13:01the son was in school,
13:04uses the computer to learn,
13:07has to allegedly suffer?
13:12That's why we have trials,
13:14Mr. Roy.
13:15But I'm going to tell you now,
13:18if you think
13:21that I'm about to give you
13:23a PR bomb,
13:25you got me bent sideways
13:27because
13:29there's no way
13:32that me, here,
13:36with all your priors,
13:39being on felony probation
13:42for injury to a child,
13:44are now allegedly
13:46trying to injure,
13:47yet,
13:48please tell me it's not
13:49the same complaining witness.
13:50That's what I'm trying
13:51to figure out right now, Judge.
13:57Because on the previous case,
13:59it was his nephew.
14:01So I'm trying to figure out
14:02if it's the same child.
14:04It's not.
14:06Shame.
14:07And I was allegedly, too,
14:08on the probation case.
14:10So this is why I'm here.
14:12That was alleged, too,
14:13because they put me
14:14at the same address.
14:17If you're not guilty,
14:19then don't plead guilty,
14:20Mr. Roy.
14:21That's just the bottom line.
14:23Don't come in here.
14:24I didn't have a choice.
14:26You didn't have what?
14:27I didn't have a choice.
14:28You always have a choice.
14:30There's always a choice,
14:32Mr. Roy.
14:33Don't come in here,
14:34try to piss on my leg
14:35and tell me it's raining.
14:39I think that you are
14:41a complete and utter danger
14:43to the community.
14:46Really.
14:49Your what?
14:55Lori.
14:57I'm sorry,
14:58but there are some people
15:00who really merit
15:02either a PR bond,
15:05a lower bond.
15:07At times,
15:09I really think
15:11that
15:12they deserve even
15:13a higher bond.
15:14His bond is $2,500
15:16right now.
15:17I think that is
15:18completely insufficient,
15:19and I'm raising your bond
15:21way higher, Mr. Roy.
15:23I think you're a complete
15:24and utter danger
15:25to the public,
15:26and I'm going to do
15:27everything in my power
15:29to protect every single person,
15:31including
15:33nephews.
15:41And I'll find a problem to cause.
