02:51I think that's the trigger concern or issue for congressmen.
02:57Because I announced or because of our resolution that was promulgated last week, there's no substitution in case of withdrawal.
03:05So there's no need to rush because there's no change and therefore, the list is final. It's not that easy, Ma'am Malu, because like what I explained,
03:14there are implications, the closer filing or the earlier filing.
03:19Now, regarding being a candidate, we clarified and I will repeat this in your program.
03:26Supreme Court said in the case of Peñera v. COMELEC, which is also included in Republic Act 9369,
03:33if all the candidates filed in an automated election, they are not yet candidates.
03:39It means that they will be able to go around, they will be able to give their votes when they appear on our streets.
03:46They will not be able to file their cases because they are not yet candidates.
03:52All their expenses from October, November, December, January, until February, in the middle, and March, until the local position,
04:01they are not yet candidates and they don't need to reflect on the statement of contribution and expenditures.
04:08The Supreme Court said that they are only candidates on the first day of the campaign period.
04:14Senators appear 90 days before the election and local positions appear 45 days before the elections.
