00:00So I got to tell you something I am
00:03shocked beyond words that
00:06JLo and Ben Affleck
00:09Didn't have a prenup. This was her fourth marriage his second
00:14It didn't work out for them the first time. It is a mess not to have a prenup
00:20I know they were in love right because here's the thing about love
00:23Everybody who gets married makes an assumption. It's gonna be for the rest of their lives
00:28About half the time it doesn't work out. So
00:31the idea that after that many marriages
00:35I just assumed that there would be a prenup right? We know there is no prenup in this
00:42Right, that's why by the way, this is dragged on for so long. Absolutely
00:46They were both very active during this two-year period Harvey where they were married
00:51They both worked on a bunch of different projects that brought in millions and millions of dollars
00:56And now it's like how do you split that up because there's no prenup
00:59So no prenup means this is all community property for the two years that they were married. I married in July of

01:11Why don't you mention some of the movies that he did and cheated because these would all be

01:19They created a company called artists equity, which we're gonna which we're gonna get into in a minute, right?

01:33There were other films as well hard all community property, right?
01:36Jennifer Lopez for her part also worked on incredibly popular movie Atlas
01:41It was the biggest movie going on Netflix for a period of time. She had married me. She had shotgun wedding with prime

01:48She launched an alcohol company and and by the way, Netflix then made a multi-picture deal with her after Atlas
01:55So you have that all again, right?
01:57What happens with that unity property which means they have to figure out how to divide all of this stuff
02:02we'll get into the house in a minute, but in terms of
02:06What they are dealing with there is now a third person in this divorce
02:11Matt Damon and here's why because in November of
02:162022 which is just a few months after
02:19They got married which is critical
02:22Matt Damon and Ben Affleck formed this company artists equity
02:26And they have produced a number of projects including projects for her
02:30But the projects you mentioned for them does that indicate that she owns half of Ben's piece of the company?
02:37Oh, this is always an issue in divorces
02:41What kind of stake does Jennifer Lopez have in this company
02:47It was created and it propelled
02:50Once they were already married and that then becomes
02:55Community property. The question is how far into the future does it go? Is she a permanent partner?
03:01What's gonna have to happen is there's gonna be a lot of horse trading here because they haven't been able to settle this thing yet
03:08Yeah, so so sorry all the value of that company that has grown during the course of the marriage is definitely community property and
03:15Then the benefit to the company that happens after their marriage is still part of that marriage that company was formed during their marriage
03:22She has an entitlement to all that to to a share of that and to your point about Matt
03:28Damon's now a third person in that in that in that divorce
03:31It's because that's a partnership between Matt and Matt and Ben and that partnership
03:36they now have a third partner in that and that is Jennifer Lopez and she has a
03:41Not only an equity entitlement or a monetary entitlement to what they make but also she's you know
03:47Again, partially a partner in this entire enterprise
03:51So they got to figure out how to divide this up because what will ultimately happen here is
03:57They'll figure out some value of what her share is worth and they'll settle for it
04:03This is not gonna end up in court
04:05They'll end up settling this but it's messy and now they've got this house that they paid almost 61 million dollars for
04:12And they can't sell it. There are no buyers
04:15This was always a really hard house trying to sell it for 68 million and and they're they're gonna take a big loss in this
04:22They have to pay a mansion tax. They have to pay they have to pay a realtors fee
04:26They had improvements of a couple of million dollars and it is a hard house to sell because of where it is
04:32It's a whole thing, but it's a mess Jason. I want you to assume
04:38We're Jennifer Lopez and Ben Affleck. I'm not gonna say which is which okay
04:42It's just gonna add and and we are gonna tell you as our lawyer going into this
04:48We don't want a prenup because this is gonna last forever
04:51What would you say to us you have got to be kidding me? What an asinine decision?
04:57I mean, honestly, I it's not even about the money
05:00They are both insanely wealthy
05:02It is about when you start to unwind a marriage and you have these kind of kind of monetary divisions
05:08It creates animosity between you. It's impossible to have an amicable resolution when you have tens of millions of dollars at stake
05:16Even if you're worth hundreds of millions, it's just it's so incredibly
05:21Dumb and short-sighted especially you made this point to people who have both been married a number of times
05:27It just makes no sense makes no sense and by the way, you know, one of the things that confused me
05:34For the many months where we knew they were gonna get divorced
05:38But she never pulled the trigger until last week
05:40One of the things we knew we assumed was the only real asset was the house and wait it down the middle
05:47Yeah, it's easy
05:48And so why did it take so long and I could never figure that out and never in my wildest dreams
05:54Did I assume that it was because they didn't have a prenup and they had all this other stuff
05:59but what's happened is that
06:01Because it's so difficult. I think that the negotiations got nasty
06:07We knew there was a long period where they weren't even talking to each other
06:11But now it all makes sense that it was never just the house
06:15It's all these other things and they're gonna have to figure this thing out
06:20Francis Caramar from Minnesota the fact that they did not sign a prenup is just gonna get messy
06:27both have considerable assets that will have to be dealt with in their divorce and
06:33Jello filed the divorce also with no lawyer, which is just crazy
06:36that just means whatever both of them made overdue nearly two years of marriage is just
06:41Honestly, I would think is probably gonna have to be split equally. I gotta figure that out
06:46I mean what what is equally when it comes to a company that has kind of an infinite possibility, right and
06:53There they got to figure this thing out
