00:00Is the Parliament supreme or is the Supreme Court's decision-making supreme?
00:07It seems that two important institutions are facing each other.
00:12There is no way to back out.
00:15I don't think anyone has an option.
00:18What do you think is going to happen next?
00:20Will it be firm?
00:21Or do you see some sanity prevailing?
00:25Thank you very much.
00:30I think it has become firm.
00:33If all institutions follow their own laws and regulations,
00:40then what you have said that the Parliament is supreme,
00:44it legislates, its laws have been created,
00:50they have made it,
00:52they have the right.
00:54When it was elected in 1970,
01:00it was named Legislative Assembly Elections.
01:08But there is a saying of the American Chief Justice,
01:12what is the Constitution?
01:13The Constitution is supreme.
01:15The Constitution is made by the Parliament.
01:16But what is the Constitution?
01:17It is what we define.
01:20But there is one thing in it,
01:22when it is defined,
01:24then the nation, the Americans,
01:26or the Indians,
01:28they are not divided.
01:30Then you see,
01:32with the Constitution,
01:34this kind of situation,
01:36this is not the first time.
01:38I was sitting in the program yesterday,
01:41there are 12-14 incidents in my mind.
01:44I have told you the big ones.
01:46In 2015,
01:48Jawaharlal Nehru,
01:50in Article 251,
01:52which was made in 1953,
01:54he had lost his sleep
01:56about the Urdu language.
01:58And there are some laws on it,
02:00which are not being implemented.
02:02And not all of them have come together.
02:04There is the Constitution,
02:06there is the Republic,
02:08which was not implemented after 1973.
02:10Jawaharlal Nehru took only one vote,
02:12he became the Chief Justice for four months.
02:14And then he gave a decision.
02:16And within 120 days,
02:18in the Latin spirit,
02:20everywhere, the decision was written in Urdu,
02:22that there will be Urdu language here.
02:24There was a competition,
02:26there was a court,
02:28everything was done.
02:30Has it been implemented?
02:32Has there been a review petition on it?
02:34Has there been an appeal from the National Assembly?
02:36It has not come.
02:38This means that the decision
02:40given by the mighty Supreme Court,
02:42the mighty Chief Justice,
02:44like Mr. Bandyal said on 15th May,
02:46the KPK, Punjab,
02:48and the KPB are also waiting,
02:50we will keep it,
02:52this election will be held on 15th May.
02:54The countdown has started,
02:56we were there for so many days,
02:58your media, God willing,
03:00has a very aggressive role in it.
03:02And they also had a very
03:04strict eye on it.
03:06And we used to say in our programs
03:08that this is such a long time left,
03:10it seems that it has not been done.
03:12It has been said that
03:14this cannot be implemented technically.
03:16Will Mr. Bandyal's ears be pierced?
03:18No.
03:20Nothing happened to the Supreme Court?
03:22No.
03:24Even now, Mr. Mansoor-e-Ishaq,
03:26according to me,
03:28the 10 best judges in the history of Pakistan,
03:30I include
03:32Qazi Faiziyah and
03:34Mansoor-e-Ishaq.
03:36They are outstanding judges.
03:38They are extraordinary judges.
03:40But Mr. Mansoor-e-Ishaq said
03:42that there is no option.
03:44But you will have to do it.
03:46But one thing that
03:48Mr. Mansoor-e-Ishaq did not say,
03:50he said that when they
03:52transgress the constitution,
03:54they do it technically.
03:56You are not interpreting,
03:58you have transgressed,
04:00for which there is no permission.
04:02Or when Umar-e-Tahab Bandyal
04:04made Chaudhry Pervez-e-Ilaichi
04:06the Prime Minister,
04:08I will say one thing,
04:10that when you
04:12transgress the constitution,
04:14the Supreme Court,
04:16they should take this
04:18very serious
04:20step.
04:22Because the people who
04:24have been transgressing for 75 years,
04:26they will interpret
04:28all these things
04:30and transgress.
04:32So for God's sake,
04:34stay within the constitution
04:36which has been given by Mr. Niazi.
04:38He is speaking factually correct.
04:40Mr. Niazi, this Supreme Court
04:42was not like Mr. Bandyal's Supreme Court.
04:44It was weak,
04:46it had flaws,
04:48it had a lack of unity.
04:50In this Supreme Court,
04:52especially this decision
04:54can have a difference
04:56in its technicalities.
04:58But everyone agrees
05:00with the interpretation
05:02of the original 13th January decision.
05:04Do you think this is different?
05:06Wouldn't it be easier
05:08to pass this decision
05:10than to pass the decision
05:12of Mr. Bandyal's court?
05:16The first aberration
05:18comes when
05:20Sanju said
05:223,000 years ago
05:24in the auto war,
05:26know your enemy and know yourself.
05:28Either
05:30like
05:32Mr. Niazi
05:34was saying,
05:36either I
05:38don't understand
05:40that they really don't know
05:42against whom the Supreme Court
05:44is contesting.
05:46If it is contesting against
05:48the government of Shahbaz Shaikh,
05:50then I will agree with you
05:52and agree with them.
05:54But the back cover is different.
05:56Everyone knows.
05:58This means that
06:00they are
06:02just expediencing.
06:04They are
06:06just
06:08consoling themselves.
06:10But the crisis is
06:12that the Supreme Court
06:14has 11 judges.
06:16What is the decision
06:18of 13 of them?
06:20And I don't think
06:22that the government
06:24accepted it.
06:26In which Mr. Kali is also included.
06:28You give it to the Sunni
06:30Unity Council.
06:32Or I don't know,
06:34give it to the PTI.
06:36You get more strength in that.
06:38If all the judges had decided
06:40in the same way,
06:42then I think it would not have been possible.
06:44But when they said that we dissolve
06:46Sunni unity,
06:48they had to do 4-5 things.
06:50PTI is not there,
06:52but as you said,
06:54Mr. Niazi said something
06:56that I don't know
06:58what the logic is.
07:00I don't remember.
07:02Because the optics type
07:04was like this,
07:06and everyone agreed
07:08to the 8 judges.
07:10And on the other hand,
07:12what should be said
07:14is that
07:16the decision
07:18in which
07:20the Sunni Unity Council
07:22who did not have seats,
07:24or they were given
07:26a statement,
07:28you took their seats back.
07:30That your party is over.
07:32So I don't think
07:34it could have gone unattended like this.
07:36The rest, Mr. Tehreek,
07:38or our intellectual friends,
07:40or our other media people,
07:42are obviously correcting
07:44the interpretation.
07:46But behind that,
07:48there are also our desires.
