04:11This section has a maximum punishment of 2 years in jail.
04:14But on the other hand, Section 304 states
04:17Culpable Homicide Not Amounting to Murder.
04:20Culpable Homicide means that you knew that
04:23if you made a mistake, someone could die.
04:26And yet you made this mistake.
04:28Although it's not murder.
04:30That's why Culpable Homicide Not Amounting to Murder.
04:33Because murder has a direct intention of killing someone.
04:36Here, it's not that.
04:37That's why the maximum punishment for Section 304 is 10 years in jail.
04:41This is the biggest difference between Section 304A and Section 304.

06:25That means this test was done on a sample which was already clean.
06:29The Agarwal family had given Rs. 3 lakhs to two doctors for this blood test.

11:42This is a crime where the minimum sentence
11:44is at least 7 years.

11:48But in this specific case,
11:49in Vedant's case, the problem is that
11:51even section 304 of IPC
11:54does not give a minimum sentence for jail.
11:56The maximum sentence is 10 years,
11:58but there is no minimum sentence.
12:00That's why even in this IPC section,
12:02it is not included in the category of heinous crime.
12:05And coincidentally, Vedant's age
12:07is only 4 months younger than 18 years.
12:10In legal language, there is a concept of
12:12Dolly in Capex,
12:13i.e. the age of criminal responsibility.
12:16It is believed that children below a certain age
12:19can not intentionally commit a crime of their choice.
12:22That's why the punishment for children

13:20That's why I believe that Vedant should not be kept as a minor,
13:23but should be kept on trial like an adult.
13:25But because of this one legal technicality,
13:27criminals like Vedant have already escaped.
13:30Look at this case of 2016.
13:324 days before his 18th birthday,
13:34a 3-time repeat offender, Juvenile,
13:36drives a car over a 32-year-old man in Delhi.
13:39First, the family's driver comes forward
13:41and says that he was driving the car.
13:43But later, he takes his statement back
13:45when he finds out that the victim died in it.
13:48In June 2016, the Juvenile Justice Board says
13:51that this boy should be kept on trial like an adult.
13:54And this was very logical
13:55because he was only 4 days younger than the age of 18.
13:58And he was also a repeat offender.
14:00He committed this crime again and again.
14:02But in 2020, the Supreme Court denies this
14:05by saying that Section 304
14:07is technically not a heinous crime.
14:10That's why he should be tried like a minor.

14:15another incident like this is heard in Kanpur.
14:18A 15-year-old boy kills two people
14:20in a motor accident in October 2023.
14:23Despite being charged with Section 304,
14:25he gets bail easily.
14:26This year, in the month of March,
14:28he once again commits a hit-and-run accident
14:30and kills four more people.
14:32Once again, Section 279338 is imposed on him.
14:35But he gets out of it very easily.
14:38Finally, he is arrested on 22nd May
14:41when the news of the Pune case was spreading on social media.
14:44And people were getting angry.
14:46I believe that if the law treats such people
14:48like a minor again and again,
14:50then all the responsibility should be put on the parents of these criminals.
14:54The parents who allow their children to drive
14:57at the age of less than 18 without a driving license.
14:59The parents whose children do such things
15:01because of their poor parenting.
15:03And the parents whose intentional mistakes
15:06cause people to go to jail.
15:08If you can't punish these 15-year-old criminals,
15:11then at least punish their parents.
15:13Because they were the adults
15:15who allowed their children to do all this.
