Transcript
00:00The Law Department of the Commission on Elections, or COMELEC, is now forming a fact-finding committee after an investigation involving suspended Bamban Mayor, Alice Guo.
00:09Attorney John Rex Laudianco, the COMELEC spokesman, is in charge of the technical examination of the fingerprint and handwriting on Guo's records.
00:18They hope that the Law Department will issue a recommendation to submit to the Commission and Bank to see if the information they have gathered is enough to see if they have a law against Guo.
00:30If there is one, the Commission will file a motu proprio complaint for material misrepresentation, election offense, and criminal case.
00:39A preliminary investigation will follow, where the respondent will give an opportunity to explain.
00:46If there is a probable cause for violation of the election law, the next step is to file criminal information to the Regional Trial Court.
00:55You may ask, why to the RTC? First of all, that is where the law is based according to the Omnibus Election Code.
01:01Secondly, because of election offense, one can be jailed for up to six years, the right to vote is removed, and there is perpetual disqualification to hold public office, the court must decide on this.
