00:00The Kuala Lumpur High Court will hear a bid by ousted Nanggiri Assemblyman Azizi Abu Naim
00:07to halt the by-election to fill the seat he was forced to vacate.
00:12The injunction application will be heard by Judicial Commissioner Rose Mawar Rozain on
00:16Thursday afternoon.
00:17However, FMT understands that the Election Commission intends to object to the application.
00:23Azizi filed his suit earlier this week to challenge his purported sacking by Presatu
00:27as well as the vacancy of the Nanggiri state seat.
00:31Presatu said Azizi's membership had ceased after he failed to declare his loyalty to
00:35the party and continued to support Prime Minister Anwar Ibrahim's administration.
00:40In his lawsuit, Azizi contends that amendments to Clause 10 of Presatu's party constitution,
00:45which stipulate that a member's membership will cease if he supports a political rival,
00:49are unconstitutional.
00:51He wants the court to strike down the amendments on grounds that they violate the federal constitution.
00:56Azizi also wants the court to declare the notice issued by the Kelantan State Assembly
01:00advising the EC of the vacancy null and void, as he was not given a chance to defend himself
01:05before the seat was vacated.
