00:00The Justice Department is taking a Texas doctor to court after he exposed a children's hospital
00:06secretly performing gender care for children.
00:09The doctor says he is accused of violating medical records laws.

00:16How is the doctor reacting to this?
00:18Well, he vows to fight the charges, John.
00:21The Dallas area surgeon learned of his indictment this week when U.S. marshals knocked on his
00:25door and gave him a summons to appear in court.
00:28The charges are currently under seal, but attorneys for Dr. Eitan Heim say he's facing
00:34four felony charges for HIPAA violations.
00:37Now his lawyers say that he shared redacted records claiming to show Texas Children's
00:42Hospital provided gender transition care to kids after the hospital's CEO claimed the
00:47clinic shut down shortly after Texas lawmakers banned gender transition care for children
00:53in the state.
00:54And now Dr. Heim's lawyers say he's being punished.
00:57He saw the surgical schedules and he knew that was contrary to what the hospital's CEO
01:03had publicly stated.
01:04In our mind, the Department of Justice has stepped into the public square to go after
01:09someone who's been a whistleblower.
01:12Take a look at this, John.
01:13Dr. Heim posted on X quote, they wanted to intimidate me into silence using every technique
01:19the federal Leviathan had at their disposal, but they failed.
01:23The only way to lose is to submit to corruption.
01:26It's time to fight back harder than ever.
01:29One of Heim's attorneys tells Fox quote, my client is anxious to get to trial to get his
01:33side of the story told.
01:35I'm confident this will result in the correct decision being made.
01:39Texas Children's Hospital is one of the largest children's hospitals in the world.
01:44We've reached out to them and the U S attorney's office for the Southern district of Texas.
01:48But so far we haven't heard back.
01:51Dr. Heim will appear in federal court a week from Monday on June 17th in Houston, where
01:56he will learn more about the charges he faces.

02:00Hey, so quick question, Nate, uh, apparently Heim is contending that none of the documents
02:04that he sent out to Chris Ruffo about this contain any information about the patients.
02:09So how is that a HIPAA violation?
02:11Well, that's exactly right, John and Ruffo actually posted himself saying that, uh, no
02:16patients information was actually shared and that Dr. Heim successfully redacted all
02:22of the privileged information.
02:24So it's certainly something that we'll be watching for when he appears in court a week
02:27from Monday.
