Once a staunch opponent of Arvind Kejriwal's Delhi Liquor Policy, the Congress party now opposes every action following his arrest. Abhishek Manu Singhvi leads the fight for Kejriwal, sparking doubts about the party's motives. Tehseen Poonawalla joins us in "24 ki Chaupal" to delve into this matter.

00:00 Hello and welcome. You're watching One India News. This show is bold, bold and as the name
00:12 suggests there are so many developments happening as we inch closer to the general elections
00:17 2024. What is transpiring in New Delhi is something which is nothing short of surprises
00:25 to many political parties. Yesterday it was Congress, today Aam Aadmi Party, once again
00:29 even Arvind Kejriwal being arrested yesterday and before that in the day we saw the Congress
00:36 party, the whole gamut coming out to the media and telling them the story, the situation
00:44 that how the funding has been seized as of now, the money, the bank accounts have been
00:49 seized. All those things once again are putting the BJP in the dock and to discuss the matters
00:54 further we are joined by Tessin Poonawalla, a senior political analyst and Keshav Karan,
00:59 my colleague, editor of OneIndia.com. Tessin, first things first, double whammy, both for
01:07 Congress and for Aam Aadmi Party. How do you see the developments in light of what the
01:13 Aam Aadmi Party and Congress claim to be targeted systematically?
01:18 Pankaj, thank you so much for having me on the show and such an honour to be with Keshav
01:23 and Keshavji. Two very quick points. One, I have and we've all covered politics, Pankaj,
01:28 you have a very long career covering politics. And of course, there is politics, there is
01:33 political vendetta, we've seen parties go after each other. But the one thing that was
01:37 that kept India apart from everything within our address, within our geography, was free
01:42 and fair elections that provided a level playing field. How is it a level playing field? In
01:47 terms of the principal opposition party, the Congress, you have a tax claim of 14 lakh
01:52 rupees. Please understand, political parties are exempt from paying tax. This 14 lakh rupees
01:57 is now Rishis 200 crore rupees for this 14 lakh rupees. Okay, this at a time when there
02:02 was a delay in filing the tax returns. It's not that he did not file it. Why was it delay
02:06 in filing the tax returns? There was COVID and the treasurer died as per the election
02:11 commission. So Motilal Vohraji died. As per the commission, election commission, the treasurer
02:18 is responsible for filing it. So you first file it to the election commission, then to
02:21 the income tax authorities, because that's your adjudicating body. So because of that
02:26 delay, with an exception from the election commission, they filed it on a delay, but
02:29 income tax has gone after them. Now they've gone after them on a 90s notice on a 90s notice
02:34 who has let's ask your viewers who has their income tax papers from the 90s. If this is
02:39 not vindictiveness, what they're ready to pay the 14 lakhs, you can charge them 14 lakhs
02:43 in some penal amount and allow it to go on. And on a matter where they've gone to a tribunal
02:48 where the income tax is ruling against them. It's terrible. Look at Arvind Kejriwal today
02:53 in court just now before I joined the show, he says they have to establish a money trail.
02:58 If you don't have a money trail, why is Sanjay Singh and Manish Tisori in jail for one year,
03:03 few months and four months in jail? That time you said the money trail was there. And you
03:07 know in PMLA, you're guilty until you prove yourself innocent, the twin conditions. But
03:12 to get bail, you don't go into facts of the case. Therefore, he will get away saying anything
03:16 sensational, and nothing will come out of it. We're living in absolutely draconian times.
03:21 Should a chief minister be arrested? Because you have to find evidence is the power to arrest
03:27 equal to the necessity to arrest somebody? Where was he running away? What is this? And,
03:32 and there's one last point. Arvind Kejriwal has been arrested on the basis of a statement
03:38 of somebody who was initially an accused. From an accused he then pays money to the BJP,
03:44 via electoral bonds, becomes an approver, and names the political rival of the BJP,
03:50 and then subsequently pays another 40 crores to the BJP via electoral bonds. And that man's
03:54 statement is taken as as a statement. This is this is ridiculous. That's what's going on.
03:59 Absolutely. So, you know, Keshavji, before, you know, I let you take further questions with
04:05 the scene, very critical aspects here. Guilty until proven innocent, whereas the rest of the
04:12 laws would say, innocent until proven guilty, even within India also. Is this, you know, the timing
04:18 and the use of the Brahmastra, as Tahseen put it as the draconian system on? What is your take on it?
04:25 So, I have the clear opinion that the law takes its own course.
04:31 Yes.

08:51 what is the evidence for which they need to be arrested or questioned.
08:57 And after the court's approval, the process of EDI has progressed.
09:03 But what evidence is in the public domain, Mr. Keshav?
09:06 Did you read the evidence? I didn't read it. Mr. Pankaj didn't read it.
09:09 I'm saying that. Mr. Keshav, the court can't see that.
09:12 Mr. Keshav, democracy can't be abstract.
09:14 The court can't see that. Mr. PM can't see that.
09:17 Sir, everything should be in front of the people in democracy.
09:21 If a Chief Minister... Sir, just a minute. Sir, just a second.
09:24 You are making people a fool.
09:27 Yes, sir.
09:29 Mr. Keshav, the court has started to make decisions.
09:34 So, what will be the importance of the institutions that your governments have made?
09:42 No, the EDI should understand what is the importance of it.
09:46 Sir, the EDI was formed when it was imagined in the United Nations.
09:53 It was for terrorism and drug funding.
09:55 When Mr. Vajpayee passed this law and Congress approved it,
09:58 the objective of terrorism funding is terrorism and the prison is related to terrorism.
10:02 Today, sir, in EDI, a finance...
10:05 ...pass it so that it doesn't go to the Rajya Sabha.
10:08 Because they didn't have a majority in the Rajya Sabha at that time.
10:10 The current government has put copyright in it.
10:12 Sir, copyright means that you and I, if the government likes it,
10:16 can put Mr. Pankaj in the copyright jail in EDI.
10:19 And say that we got 300 crores, Tehseen gave 300 crores to Pankaj.
10:22 We know that there is a fraud here.
10:24 Now we will investigate it. We will be in jail for 1.5 years.
10:26 Nothing will happen. We will be released after 1.5 years.
10:28 Sir, there are about 20,000 cases of EDI.
10:30 10 or 12 cases got bail. Why, sir?
10:33 Sir, I will tell you a similar case.
10:35 A person who has been arrested in EDI,
10:38 he summons him to EDI.
10:40 He goes to Delhi High Court and gets an anticipatory bail.
10:42 It is very difficult to get an anticipatory bail.
10:44 He summons him to EDI on Friday and gets an anticipatory bail.
10:47 EDI does not arrest him in that case.
10:49 It arrests him in another case on Friday evening.
10:51 And then EDI argues that there is no reason to arrest us.
10:56 You don't need to tell the reason in EDI because we are not the police.
10:59 Sir, is this a logic in a democratic country?
11:02 I am genuinely asking you.
11:03 Leave this, whether you are a supporter of BJP or Congress.
11:05 Should this be in a democratic country?
11:07 Yes or no, you tell us in that case.
11:09 We have told the court secretly.
11:11 What is the secret?
11:12 You tell Keshav ji.
11:13 Tell Pankaj ji.
11:14 If Arvind Kejriwal is a thief, keep it in the public domain.
11:17 You say that there is a 300 crore money trail in the case of Suto.
11:20 In the court, you say that we have to establish it.
11:22 What is this?
11:23 Unfortunately, the court is convinced.
11:27 No, sir.
11:29 The court is not convinced.
11:31 I am telling you again, sir.
11:32 In the case of EDI, God forbid, you or I get arrested in EDI.
11:36 You will be guilty until you prove yourself innocent.
11:41 And to prove innocence, the court does not go into the facts of the matter.
11:44 Please understand this.
11:46 So any agency will come and say that we got a 100 crore trail from Tehseen.
11:50 We need 10 more days of his custody.
11:52 The court has to go with the presumption that you are guilty, sir.
11:55 And that's what distinguishes EDI.
11:58 That's why I said that it has been used like a master.
12:01 EDI is obviously a financial fraud.
12:04 And it is used in financial dealings.
12:08 The way it is being used, it is targeting criminal cases.
12:12 Tehseen, I know time is of a sincere and you are hard-pressed on time.
12:15 One final question.
12:16 The heat is on.
12:17 The onslaught is also on.
12:18 We have seen since the India Alliance came into picture,
12:22 there has been these developments.
12:25 Not just here, down south also.
12:27 DMK too feels the heat.
12:29 In Bengal, we have seen how the attacks from the BJP on the DMK have been.
12:34 How do you see the Alliance tackling it as we head to the elections?
12:40 The Alliance will have to be united.
12:42 They will have to meet the election commissioner.
12:43 They will have to go to courts together.
12:47 They will have to go to the Honorable President of India.
12:49 They will have to make it a political fight.
12:51 One is a political fight.
12:52 But I want through your medium, your viewers to understand.
12:55 The Honorable Prime Minister and the BJP targeted Chagan Bujbal personally.
12:59 Targeted him personally.
13:00 Said he is absolutely corrupt.
13:02 When Chagan Bujbal and Ajit Pawar joined forces with the BJP,
13:05 Chagan Bujbal's file was lost by the same enforcement directorate.
13:09 They lost his file and therefore they shut the case.
13:11 A BJP MLA was found with 9 crore rupees cash.
13:15 9 crore rupees cash.
13:16 The case is closed now because in court they said we raided him without taking his permission.
13:20 This is what is going on.
13:23 And if we don't speak about this,
13:25 Himanta Biswa Sharma, a white paper against him was removed by BJP.
13:28 Today he is an approver.
13:30 So if you join the BJP from an accused, you become an approver.
13:32 Just like this gentleman who has become an approver against Arvind Kejriwal ji.
13:36 And he has given BJP 5 crore rupees and then 40 crore rupees subsequently.
13:40 It's criminal.
13:41 And it should be spoken about.
13:43 Right.
13:45 Tazim, thank you so much.
13:48 I know it calls for another long discussion.
13:51 But thank you.
13:53 As always a pleasure to speak to you.
13:55 Kishan Karn, thank you so much.
13:57 Thank you, Tazim.
