00:05 Yeah, Ariana, I think, is going to defend this in a couple ways. Maybe say that, you know,

00:10 this was consensual, the fact that she accessed it and sent it to Rachel herself. She didn't send

00:17 it to anyone else. And what I think she's really going to try to do, though, is I think the lawyers

00:22 who are going to defend Ariana in this case are really going to attack the damages here. And

00:27 it's no question that Rachel suffered some emotional distress. She had to check into a

00:31 rehab facility. But I think what the lawyers will argue is that this was all Rachel's own doing

00:38 because of this assorted affair or previous substance abuse problems. And any harm she

00:44 suffered, it wasn't because of anything Tom or Ariana did. It was because of Rachel's own doing.

00:50 So I can see the case being defended on that ground.

00:53 Right. So who do you think will come out on top? Will Ariana and Tom have to

00:58 pay Rachel any damages? Do you foresee that happening?

01:02 I think this case is really going to turn on how many people the video was sent to. You know,

01:08 if it was disseminated far and wide and there's a video out there of Rachel naked and masturbating

01:15 and, you know, dozens or more people have seen it, that's a big problem. And I'm not comparing

01:20 the two cases, but we saw the Vanessa Bryant case. I think one of the reasons the jurors

01:25 awarded so much money is really how far the video had gone. And that's one of those things.

01:29 Once it's out there on the Internet, you can't really unring the bell or put the toothpaste

01:34 back in the tube or whatever analogy you want to use. You know, but if it was really limited

01:38 in terms of the distribution and it just went to Ariana, Tom and Rachel, I think it's a much

01:44 quicker case.
