The Court of Appeal has ruled that vernacular schools are constitutional, dismissing the appeal of four non-governmental organisations (NGOs) which sought to declare that the use of Chinese and Tamil languages as the medium of instruction in vernacular schools goes against the Federal Constitution.

A three-member panel comprising Justices Supang Lian, M. Gunalan and Azizul Azmi Adnan handed down the decision on Thursday (Nov 23).

00:42 The Court of Appeal had ruled on the appeal by four non-governmental organisations including
00:48 the Islamic Education Development Council or MAPIN over the issue of vernacular schools
00:53 and the use of Mandarin and Tamil in the schools involved.
00:58 MAPIN Gapena Ikatan Muslimin Malaysia and Ikatan Guru-guru Muslim Malaysia or iGuru
01:04 had appealed against the decision of the Kuala Lumpur and Kota Bharu High Courts that dismissed
01:09 their suits in December 2021 and May 2022 respectively.
01:14 On December 29, 2021, Kuala Lumpur High Court had dismissed the lawsuits brought by the
01:20 Federation of Peninsular Malay Students, MAPIN Gapena and ISMA.
01:25 Muhammad Nazlan had ruled that the existence and establishment of vernacular schools and
01:30 the use of Mandarin and Tamil languages at those schools were constitutional.
