00:00 - All right, Ms. Powell, I just have a few questions for you.
00:02 Do you understand the nature of the charges
00:04 that have been reaccused
00:05 that you would be pleading guilty to today?
00:07 - I do, sir.
00:07 - And you've heard all the rights
00:08 that the state has gone through
00:10 that you would waive by going forward with this plea.
00:12 Do you still wish to waive those rights?
00:13 - I do.
00:14 - And are you pleading guilty today
00:15 because you agree that there is a sufficient factual basis,
00:18 that there are enough facts
00:19 that support this plea of guilty?
00:21 - I do.
00:22 - Mr. Rafferty, are you satisfied your client
00:24 is competent in understanding that the plea is voluntary
00:27 and that there is a sufficient factual basis
00:28 for entering this plea?
00:29 - Yes, your honor.
00:30 - I agree and find that there is a sufficient factual basis
00:36 and I find this plea of guilty
00:37 to be knowingly, voluntarily, and intelligently entered.
00:40 There's been a request that this sentence be entered
00:44 under the First Defender Act
00:45 and the court will approve that request,
00:47 withhold adjudication.
00:48 But I must notify you, Ms. Powell,
00:49 that you are not allowed to withdraw your plea
00:52 simply because you do not comply
00:53 with the terms of the sentence.
00:55 And the terms of that sentence
00:56 would be as recommended by the parties
00:59 on count one, conspiracy to commit intentional interference
01:02 with the performance of election duties.
01:04 The sentence would be 12 months probation
01:07 and counts two through six
01:09 would also be 12 months probation consecutive to each other
01:12 and to count one for a total term
01:15 of essentially six years probation,
01:19 but we're going to translate that
01:20 into months for the sentencing.
01:22 Special conditions would include a $6,000 fine
01:26 with $1,000 for each count.
01:28 Restitution to be paid in the amount of $2,700
01:31 to the Georgia Secretary of State's office.
01:34 You are to have written a letter,
01:38 which you've already satisfied.
01:40 You're also to provide a recorded proffer with the state,
01:42 which you've already satisfied.
01:44 You're to testify truthfully against any
01:47 and all co-defendants in this matter
01:48 at any upcoming proceedings.
01:50 You are not to have any communication with any witness,
01:54 any co-defendant or any member of the media
01:57 concerning the facts or circumstances of this case.
02:00 And you're to provide all documents
02:03 to the district attorney's office
02:05 as requested and relevant to this case.
02:08 Again, Ms. Young, I would ask if you could provide
02:12 the state's recitation of the exact phrasing of these,
02:15 and we'll make sure that's reflected
02:16 in the final disposition form.
02:19 In order to make this sentence consistent with Mr. Hall,
02:24 I do believe it would be appropriate,
02:27 and I'm willing to include the language
02:28 involving moral turpitude,
02:30 although that language being included on the sentence form
02:35 may not ultimately have any effect on the entities
02:39 responsible for actually determining that.
02:41 Are there any other expressed conditions,
02:45 special conditions, Ms. Young,
02:46 that you would like to see reflected on this sentence?
02:50 - I think you can have it, yeah.
02:51 - Okay.
02:52 Mr. Rafferty, is there anything else that you think
02:54 needs to be on the record today?
02:56 Ms. Young, do you have an announcement
03:00 regarding the indictment in this case?
03:03 - Yes, your honor, the state will be entering
03:05 an all-possible order on indictment number 23SC188947
03:10 as it applies to Ms. Powell.
03:12 - All right, well, upon being provided
03:14 a copy of that motion, I will sign it,
03:17 and the charges in the indictment will be dismissed.
03:21 - All right, if there's nothing else,
03:23 then we will conclude this and be off the record.
03:26 Good luck, Ms. Powell.
03:28 - Thank you, your honor. - Thank you.
