00:33 A lot more on that breaking news ahead, but we begin with the drama in D.C. as House Republicans
00:38 look to expel Florida Congressman Matt Gaetz as he pushes to oust House Speaker Kevin McCarthy.
00:43 Yeah, Gaetz says it isn't personal and that he's confident he has enough support to remove
00:48 McCarthy.
00:49 Of course, disagrees.
00:52 Alexandria Hoff is live in Washington with much more.
00:55 Alex, good morning.

00:59 So House Speaker Kevin McCarthy could not rely on GOP members alone to pass the stopgap
01:02 spending bill.
01:03 And because he reached across the aisle, Congressman Gaetz said this weekend that he's making good
01:07 on a threat to file a motion to vacate against the speaker this week.
01:12 And he says he's got backup for that.
01:15 How many Republicans do you have?
01:17 Well, enough so that when you host this show next week, if Kevin McCarthy is still the
01:22 speaker of the House, he will be serving at the pleasure of the Democrats.
01:26 I will make no deal with Democrats.
01:28 This isn't personal.
01:29 This is about spending.
01:30 This is about the deal Kevin made in January.
01:32 Well, sources tell Fox News that lawmakers will move to oust Gaetz if he's not cleared
01:38 of wrongdoing in an ongoing ethics committee investigation into him and a source saying,
01:43 quote, no one can stand him at this point.
01:45 A smart guy without morals.
01:48 And Speaker McCarthy, he weighed in yesterday.
01:51 Matt's probably planned this from the day I ran for speaker.
01:54 If you watched, he never voted for it.
01:55 The only way he can be successful is if Democrats go along with him.
02:00 And based on some past statements, it seems that some would.
02:05 I think Kevin McCarthy is a very weak speaker.
02:08 He clearly has lost control of his caucus.
02:10 My advice to my fellow Democrats is simple.
02:13 Follow the leader.
02:14 Hakeem Jeffries has done a great job.
02:18 And President Biden was also asked about Gaetz's effort.
02:20 Listen.
02:22 Mr. President, Speaker McCarthy's speakership is now at risk.
02:26 Should Democrats vote to help him keep that job?
02:30 I don't have a vote on that matter.
02:31 I'll leave that to the leadership of the House and the Senate.
02:34 The speaker's made a terrible bargain.
02:36 In order to keep the speakership, he's willing to do things that he I think he knows are
02:41 inconsistent with constitutional processes.
02:46 Now for Republicans, the idea of expelling Gaetz, it is risky as they do just hold a
02:51 razor thin majority.

02:56 McCarthy isn't the only lawmaker fighting to keep his seat.
02:59 Yeah, that's exactly right.
03:01 You have New York Congressman Jamal Bowen.
03:03 He's having a really hard time defending why he pulled a fire alarm on Saturday inside
03:07 the Cannon House office building.
03:09 It forced an evacuation just as Democrats were seeking to delay a vote on the Republican
03:13 stopgap spending bill.
03:15 He says that pulling this alarm was an honest mistake, not a stalling tactic, writing as
03:21 I was rushing to make a vote, I came to a door that is usually open for votes, but today
03:25 would not open.
03:26 I'm embarrassed to admit that I act.
03:28 I activated the fire alarm mistakenly thinking it would open the door.
03:32 I regret this and sincerely apologize for any confusion.
03:35 This cause, well, fellow squad member Alexandria Ocasio-Cortez, she says she buys that explanation,
03:40 but given the timing of it all, Republicans really don't.
03:43 Congresswoman Nicole Malliotakis says she's introducing legislation to expel Bowman from
03:47 the house.
03:48 Our fellow colleague from New York, Jamal Bowman, a member of the socialist squad, actually
03:54 pushed, pulled the fire alarm to create a fake emergency to prohibit a vote on the house
04:03 floor.
04:04 And so I'll tell you this much, what he did was a federal crime and I'm putting in a resolution
04:10 to expel him from Congress.
04:14 So there's plenty of lingering chaos after an already disorienting week and lawmakers
04:19 still have to come up with a permanent spending plan.

04:25 After Saturday, I have no words.
04:26 I was listening to a podcast yesterday.
04:28 It was one of Dan Crenshaw's podcasts and the title of it is what the hell is wrong
04:31 with Congress right now?
04:32 And I think that sums up everything that you just said, Alexandria.

04:38 Now to this president Biden brushing off his negative polling numbers this election cycle,
04:43 saying he's still optimistic despite his low approval ratings and concerns about his fitness
04:47 to serve.
04:48 I think the means in which people are tracking polls now, they've kind of lost their focus
04:54 and it's hard to get it done.
04:56 Secondly, I think that, uh, I think, you know, the media has changed a lot.
05:03 Those comments come as 51% of Americans say they would vote for former president Donald
05:07 Trump, 42% for president Biden in a hypothetical 2024 matchup that according to a recent ABC
05:13 news poll.
05:14 And now to this, uh, one of member of president Biden's own party is speaking out against
05:19 his reelection bid.
05:20 Minnesota Congressman Dean Phillips says he's leaving his house leadership position over
05:24 Democrat support of Biden in 2024 saying, quote, I have decided to step down from the
05:29 DPCC and Democratic caucus leadership while politics and official work do not mix.
05:35 It's clear my convictions about 2024 are incongruent with the position of my colleagues and that
05:41 was causing discomfort.
05:43 I was not pressured or forced to resign.
05:46 Phillips has repeatedly voiced concern over the president's age and says he wants other
05:51 Democrats to step up and challenge him in 2024.
05:56 And now to this democratic presidential candidate, Robert F. Kennedy Jr. teasing a move that
06:00 some say could completely derail president Biden's reelection bid.
06:06 I'm going to be in Philadelphia on October 9th to make a major announcement.

06:51 RFK Jr. teasing a major announcement as some say he could be considering a third party
06:56 run.
06:57 I'm Ziggy White, deputy editor of restoring America at the Washington examiner joins me

07:02 Kayleigh, if this is in fact an announcement of a third party run, what does it say about
07:08 the state of the current Democrat party that one member of the biggest Democrat family
07:14 in the 20th century could be leaving the party and running for president?
07:18 Well, it's a damning indictment of the party's refusal to allow competition in this primary.
07:25 You know, there's been a lot of debate about whether a third party bid from RFK would hurt
07:29 Biden or Trump more if those are the two general election candidates.
07:33 And the reason why I say it hurts Biden more is simply for that reason is because Democratic
07:38 voters are being denied a choice in the primary.
07:42 The DNC refuses to even hold debates between Biden, RFK and the other Democratic candidate
07:47 right now, Marianne Williamson.
07:49 And they are forcing Biden onto the public even as record numbers of Americans say that
07:54 they do not want Biden to seek reelection for a variety of concerns.
07:59 This is this is an indictment of the DNC.
08:02 And they've done this years and years and years where they choose the candidate.
08:05 They force it onto voters and they refuse them a choice in this matter.
08:08 But this year, meaning 2024, it could backfire on him because the math is fascinating.
08:14 If RFK Jr. does run as an independent, let's not forget about no labels.
08:18 They're thinking about putting somebody else up there in the independent mold.
08:22 If those two run together and presumably steal a lot of votes from Joe Biden, is this the
08:27 death knell for Joe Biden's presidency?
08:31 It could very well be.
08:32 If you look at some of the polls, there's a massive appetite among the electorate for
08:36 a third party option.
08:37 One recent poll found that as many as 47 percent of Americans would consider casting their
08:43 votes for a third party if Donald Trump and Joe Biden are the nominees.
08:47 Now, could that hurt Trump as well?
08:49 Sure, there are a lot of people on the right who have a lot of respect for what RFK has
08:53 been saying and his sensibilities.
08:55 But again, Biden is the weaker candidate here.
08:58 He's losing support among his own party base as Donald Trump shores up his support among
09:03 the GOP electorate.
09:05 Joe Biden is going to be the loser in this situation.
09:08 A recent ABC News poll showing independent voters favor Trump over Biden by 13 points.
09:13 So I agree with your assessment that Trump can't necessarily become too complacent because
09:18 he does have more independent votes to lose if you go with this poll.
09:22 But is it realistic to think that somebody who would consider voting for Donald Trump
09:27 on the independent side is then going to go for somebody like RFK Jr.?
09:31 Yes, he is rebelling against the DNC, but you know, RFK Jr. is not Ronald Reagan here
09:37 when it comes to liberal versus conservative.
09:40 Right.
09:41 And I think the people who are attracted to RFK's agenda are also going to be attracted
09:46 to Donald Trump's agenda, at least if they're on the right.
09:49 And if you had to make a choice between Trump or RFK, my guess is that the vast majority
09:54 of Republican primary voters are going to choose Trump, who has proven himself to be
09:59 a solid conservative president in the White House for four years.
10:02 They're not really going to take a chance on a Kennedy Democrat.
10:05 So that's the dynamic that's at play here.
10:08 Finally, Jamal Bowman's excuses going up in smoke as new pictures show the moment he pulled
10:13 the fire alarm.
10:14 Let's take a look at the New York Post cover, shall we?
10:17 Does this look like a fire alarm?
10:18 Does that look like a door handle?
10:20 I think the irony here is rich.
10:22 What's worse here though, Kayleigh?
10:24 The crime or the embarrassing attempt at covering it up?
10:30 Absolutely the embarrassing attempt to argue that a grown man, a literate adult with full
10:36 possession of his capabilities, cannot read the words "fire alarm" and that he does not
10:42 know what that means.
10:43 This is ridiculous.
10:44 And it's embarrassing that there are Democrats and people in the leftist media who are trying
10:49 to carry water for this excuse.
10:51 Jamal Bowman was a principal of a school for more than 12 years.
10:56 And it's interesting.
10:57 I went and looked up how many times that the students at his school had to participate
11:01 in fire drills.
11:02 Well, they had about 12 fire drills a year, Todd.
11:06 So if you're really saying that he does not know how this works, that's ridiculous.
11:11 And the thing is, you're right though, this is actually a crime.
11:14 In D.C., according to statute, this is a criminal misdemeanor, not to mention the potential
11:19 felony charges that could be associated with disrupting an official congressional proceeding,
11:25 a charge which, by the way, more than 300 Americans have been charged with as a result
11:30 of the January 6th Capitol riot.
11:32 So if Republicans really want to hold his feet to the fire here, they could.
11:35 It looks like Nicole Malliotakis is planning on doing just that when it comes to potentially
11:39 expelling him.

14:17 moderate to heavy snow as well.
14:18 That front is going to march on through the Plains states, bringing the risk for strong
14:22 storms, including heavy rain, and that could cause some flash flooding.
14:25 I am concerned with Texas and Oklahoma through Friday.
14:28 So we're going to watch that over the next couple of days.

15:58 How do you feel about those comments and that advice?
16:01 Does that sum up what you're going through?
16:03 Absolutely.
16:04 Um, but one of the comments, it's time for us to get on a budget.
16:09 What happens when there is no extra funds to budget in there because the paychecks aren't
16:15 getting bigger, but those prices sure are.
16:17 Yeah, they sure are.
16:18 And people are dipping into their savings.
16:20 We know that that's the truth.
16:22 So tell us your personal story.
16:24 What are you going through as it relates to the economic conditions right now?
16:28 Okay.
16:29 So as if this is the best time, um, we had our truck break down, um, about two months
16:36 ago and then just this week my car broke down.
16:41 My husband's the only one who works.
16:43 He put himself through school.
16:44 He did what he was supposed to.
16:46 We had a 401k, which we've depleted because of inflation.
16:50 Um, and then how is my husband supposed to go to work to provide for us?
16:56 How?
16:57 So usually you would go, you would get a vehicle loan, but with interest rates so high, they
17:02 are mortgage size notes.
17:05 Maybe some people like these because they are clearly oblivious think that they can
17:10 afford that, but the average American person cannot.
17:14 Wow.
17:15 So it sounds like you're really concerned about your future and your family's future.
17:19 What is your biggest concern?
17:21 Well, um, food on the table.
17:25 Um, my husband getting back to work, um, having a way to provide for us.
17:30 Quite frankly, it's humiliating coming home, national television, admitting something like
17:34 this, but it's time for more people to suck up their pride and give the raw truth.
17:40 The American people are drowning out here and begging for a lifesaver and I just don't
17:45 know where it is.
17:46 Yeah.
17:47 Amber, I know that this can't be easy, but I think it's also important because you give
17:50 voice to a lot of people who are going through the same things as you.
17:53 So we do thank you for that.
17:55 Um, then you have president Biden.
17:56 He is out on the campaign trail.
17:58 He's his message has been that the economy is improving.
18:02 When you hear him say things like that on the news, what goes through your head?
18:09 It's a slap in the face.
18:10 It's a complete slap in the face.
18:11 It's a slap in the face.
18:12 My, in my face, my husband's face, my children's face, the average American family's face.
18:18 I just, I still don't understand this and how it's still going on, but it is creating,
18:28 it's not your job to come up with solutions, but have you given that any thought?
18:32 Like if you could talk to your local Congressman, what would you tell him that you would like
18:37 to see happen to make your life a little bit easier?
18:40 Honestly, I just want to see some type of progress, something instead of every single
18:48 month it getting worse and worse and worse.
18:52 Um, I just want to see like something.
18:55 Do they care?
18:56 Yeah.

18:58 I know that a lot of people feel forgotten out there.

19:16 Breaking overnight, former president Trump is bashing the judge in his New York fraud
19:19 case ahead of his court appearance this morning.
19:21 We have everything you need to know coming up.
19:23 And Hunter Biden also doing court this week where he is expected to plead not guilty to
19:27 federal gun charges.
19:29 Brooke Singman breaking down both cases for you.
19:34 Former president Donald Trump says he'll be in a Manhattan courtroom today for his civil
19:38 fraud trial as he calls on New York attorney general Letitia James and the judge overseeing
19:43 the case to resign.
19:44 Brooke Singman joins us with more.
19:45 Yeah guys, that's right.
19:47 The former president says he is prepared to fight for his name and reputation today as
19:51 he calls out attorney general James and the judge in the case and his truth social post
19:55 last night.
19:56 He said, quote, he should resign from the bench and be sanctioned by the courts for
20:00 his abuse of power and his intentional and criminal interference with the presidential
20:05 election of 2024.
20:07 Likewise, Letitia James should resign for purposeful and criminal election interference.
20:12 Now, these accusations come days after the judge ruled Trump and his two sons committed
20:18 a years long fraud scheme, allegedly inflating their assets on business documents to get better
20:23 loans and insurance deals.
20:25 Now, Attorney General James is seeking a 250 million dollar penalty against the former
20:31 president and his company.
20:33 Trump speaking to a packed crowd in Iowa over the weekend, claiming the cases against him
20:38 are actually helping him more than they are hurting him.
20:41 Listen.
20:42 Every time the radical left Democrats, Marxist, communist and fascist indict me, I consider
20:49 it a great badge of honor.
20:55 Because I'm being indicted for you.
20:57 Yeah.
20:58 So arguments in this high profile case are set to begin around 10 a.m. this morning here
21:02 in New York City.
21:03 And this trial could run all the way through December.
21:08 It seems like no one to me, Brooke, the DA's office, Trump's attorneys, legal scholars
21:13 have any idea what to make of the judge's decision last week in terms of what it means
21:18 for Trump's business empire going forward.
21:20 Because basically the judge said, in effect, you can't do business in New York anymore.
21:24 Because this is a business certificate.
21:25 Exactly.
21:26 So does this mean he has to divest all of his holdings?
21:28 Do we get any clarity on any of this over the weekend?
21:31 We don't know.
21:32 We're going to see all of this this week in this trial.
21:33 I mean, it's again, pretty stunning.
21:35 We talk about this every time something like this happens in the legal system against Trump.
21:39 He's going to a trial in New York City today.
21:42 This is a investigation out of Letitia James, which is the New York State Attorney General.
21:47 She has been investigating Trump, the Trump organization, his family for months, actually
21:51 for years at this point.
21:53 So he'll be in court today.
21:54 And she campaigned off of trying to get Trump.
21:57 And last year she announced that these charges could be coming, saying it isn't the art of
22:01 the deal, it's the art of the steal.
22:03 And here we are today.
22:04 And over the weekend, he was in Iowa and then he has to fly to New York.
22:07 But he only could make this court appearance if he got special permission from the judge
22:11 in Florida, because there were some conflicting things going on there.
22:14 So you could see already how this is going to play out on the campaign trail with him
22:17 campaigning in states and then having to make all these court appearances as well.
22:20 And also it's a non-jury trial.
22:22 So like like I said, I mean, the judge ruled that the president committed fraud.
22:26 It'll be really interesting to see how this plays out in court.
22:29 So we'll be watching that really closely.
22:32 Another big deal.
22:33 There is movement on the Hunter Biden front as well.
22:35 He is due in court tomorrow.
22:36 Yes, that's right.
22:37 And you know what?
22:38 Former President Trump actually has been drawing comparisons between his own legal trouble
22:42 and those of President Biden's son Hunter.

22:46 I could have made deals.
22:47 I had countries coming up to me, heads of everybody.
22:51 I'd like to make a deal with you, sir.
22:54 Biden would have made it.
22:55 Hunter would have made it.
22:56 They would have walked away with a fortune.

22:59 By the way, their deals are terrible and they did nothing for them.

23:09 This says Hunter Biden is set to appear in a Delaware court tomorrow where he is facing
23:13 those gun charges handed down by special counsel David Weiss last month.
23:17 This in-person arraignment comes after a judge rejected his request to appear virtually.
23:22 That judge saying, quote, Hunter Biden should not receive special treatment in this manner
23:27 absent some unusual circumstances.
23:29 Now, the president's son is accused of illegally purchasing a firearm while using drugs.
23:34 He's facing three separate counts, one for lying on the gun application, one for lying
