Small businesses could soon be forced to protect customers's personal information under a major shake up of the nation's privacy laws. Under the proposal, they'll no longer be exempt from protecting personal data or disclosing how they use it.

00:14 But they do still leave some gaps in protections for Australian consumers and some areas where
00:21 it's still not clear what the government is actually proposing.
00:25 This is actually a good thing in that the government is putting forward that we won't
00:30 just keep relying on this sort of ticker box approach to privacy and having companies say,
00:37 "Well, we got you to agree to our fine print, so now we can do whatever we like with this
00:42 data," and instead having a substantive rule there that requires uses and collection of
00:49 information to actually be fair and reasonable, which I think will encounter a lot of opposition
00:55 from some companies.
00:56 The definition of personal information is actually critical here because at present
01:01 companies are trying to say, "We are tracking you all over the place as an individual, but
01:08 it's not personal information because we're not using your name and email address.
01:12 We've assigned a unique number to you."
01:15 One of the things the government is proposing is that that definition of personal information
01:19 will change to include those kind of situations, which would be far fairer and more protective
01:27 for consumers.
