Demolition order for Aditya building in Mumbai

Poonam Raitatha faces a piquant situation. She lives on the 13th floor of Aditya Towers, Borivli (W), now declared illegal and ordered to be demolished immediately. Her family also owns a flat in the adjacent Nand Dham Society which went to court and sought conveyance of the plot on which the two housing societies stand.

Four other families face the same situation. "Not all members of Nand Dham support what the committee has done," she claims.

Thirteen floors of the 18-storey Aditya Towers face demolition for illegal use of floor space index (FSI) and Transfer of Development Rights. The Dindoshi city civil court last month held the BMC sanction partly illegal and ordered immediate demolition of the illegal floors. Society members allege it is greed on the part of Nand Dham Society members which has brought them to a stage where they stand to lose their homes. "The builder offered them Rs 21 lakh initially for the use of TDR and FSI. But they kept hiking their demand. Though we were not a party to the court case, we collected a substantial amount to pay Nand Dham Society as compensation. We returned the money to members three months ago as it was attracting tax,'' said R Ahir, a first-floor resident and architect of Aditya Towers. He said the building was not illegal. "As Nand Dham members filed a case, we took an opinion from the BMC's law department before proceeding with construction," he said.
