Supreme Court Nominee Brett Kavanaugh's Stance on Key Issues On Monday, President Trump announced his decision to nominate Brett Kavanaugh to fill the Supreme Court vacancy when Justice Anthony Kennedy retires. Here's where he stands on key issues. Kavanaugh has not expressed opposition to Roe v. Wade, stating that he didn't think it was "appropriate" to comment on it. However, he did oppose a district court judge decision to allow an undocumented immigrant to get an abortion. When it comes to religious liberty, Kavanaugh appears to support the rights of religious businessowners to act in accordance with their beliefs. But he also suggested that the government has a responsibility to grant contraception access to the employees of religious businesses. Kavanaugh is pro-Second Amendment, once dissenting from a majority opinion of the DC Circuit that upheld a ban on semiautomatic rifles.
