The bittersweet taste of freedom: Brooklyn man wrongfully jailed for 29 years

David McCallum was found guilty of kidnapping and shooting a man in 1985 and spent the past 29 years in prison, but thanks to lobbying by Rubin “Hurricane” Carter, who himself was wrongfully incarcerated for 19 years, the conviction was overturned.

“There is no evidence whatsoever that connects Mr. McCallum and Mr. [Willie] Stuckey to the crime that was committed in this case," said Kings County Assistant District Attorney Mark Hale during the hearing. “These [witnesses’] statements were not a voluntarily recollection and admissions of the two defendants but rather were the product of improper suggestion, improper inducement and perhaps coercion.”

Brooklyn District Attorney Kenneth Thompson used the opportunity to rail his predecessor for creating a wide swath of injustices, saying he “inherited a legacy of disgrace with respect to wrongful convictions.”

McCallum seemed as if a great weight had been taken off of his shoulders saying, “I’m feeling like I want to go home finally, after 29 years, and of course this is a bittersweet moment because I'm walking out alone, there was someone else who was supposed to be walking out with me but unfortunately he’s not, and that's Willie Stuckey.”

Stuckey, who was also wrongfully imprisoned in connection with the crime, died in prison of a heart attack in 2001. His mother Rosa Nealey attended the hearing in his stead.

A closer look into the McCallum case revealed that the conviction had hallmarks of a false confession and that McCallum and Stuckey were fed misinformation leading to their convictions.
