How To Split Debt In A Divorce

My name is Amanda Szpakowski. I am the Family Law legal assistant here at the Bornmann Law Group. I specialize in anything family law-related; custody, visitation, father's rights, anything family law.

Basically, each person will, either in their petition or their response, lay out what they believe is community debt, or separate debt. Basically, they try and come to an agreement before it goes to a hearing-type situation. It's really situational as far as debt goes. It depends on what was procured during the marriage, what each party is willing to take separately, coming to an agreement. And if the parties can't come to an agreement, it comes to a point where the judge will decide on what was procured by each party, and divide it, usually equitably, between the parties.
